Pleading violation of the order dated 3.12.2018 passed by the writ Court in Public Interest Litigation (PIL) No. 3765 of 2018, the present contempt petition has been filed.
A perusal of the aforesaid order indicates that the writ Court has issued interim direction granting liberty to the District Authorities to initiate proceedings under Section 67 of U.P. Revenue Code, in case, the said proceedings have not been initiated against the encroachers and to submit a report on the date fixed before it.
The submission of learned counsel for the petitioner is that no action whatsoever has been taken by the District Magistrate as yet and the report as per the direction of this Court on 3.12.2018 has not been filed.
Having perused the order dated 3.12.2018 of the writ Court, this Court is of the considered view that it is open for the applicant to make his submissions before the writ Court.
No case to entertain the contempt petition is made out.
The contempt application is, thus, found misconceived and hence dismissed.
