Heard learned counsel for the applicant and Sri Awadhesh Kumar Saxena, learned counsel appearing for the opposite party no. 1 and perused the affidavit filed in support of this application.
Counter affidavit filed on behalf of the opposite party no. 1 is taken on record.
The present contempt application has been filed for punishing the Opposite Party for willful disobedience of the judgment and order dated 23.5.2018 passed by the Writ Court in Writ C No. 18069 of 2018 (Shri Ram Educational Charitable Trust vs. Paschimanchal Vidyut Vitran Nigam Ltd. and others). The operative portion of the said order is quoted as under:
"Subject to deposit of 50 per cent of the arrears, the electricity connection of the petitioner may be restored."
After some arguments, Sri Nipun Singh, learned counsel for the applicant submits that he is willing to apply for new connection and his case for adjustment of the amount whatever may have been deposited in excess required to be considered.
Sri Awadhesh Kumar Saxena, learned counsel appearing for the opposite party submits that the applicant may apply for new connection and on completion all the formalities his application shall be considered in accordance with law.
In such view of the matter, this Court is of the opinion that the order of the Writ Court has been complied and no further orders are required.
Application is consigned to record.
