Petitioner is a Superintending Engineer in the Irrigation Department, he was appointed on 19.04.2017 and the departmental inquiry was instituted against him. The suspension order was not disturbed by the High Court, but a direction was issued that the inquiry be concluded preferably within eight weeks vide order dated 15.05.2017 passed in Writ - A No. 18664 of 2017 (Ram Dutt Yadav Vs. State of U.P. & Others). Thereafter an inquiry was completed and the inquiry report was submitted on 09.10.2017, pursuant to that a show cause notice was issued to the petitioner on 14.11.2017 to which petitioner has even filed reply on 19.12.2017, but no final decision has been taken.
The submission is that the petitioner is due to retire on 30th April, 2018, therefore, taking into account the earlier order of the High Court, the disciplinary proceedings should be completed at the earliest within a time bound period.
In the facts and circumstances, we are of the opinion that as petitioner is due to retire, the disciplinary proceedings should be completed expeditiously within a month and in no case beyond the retirement date of the petitioner.
The writ petition is disposed of with the above observation.
