Heard learned counsel for the petitioner and Sri Sachin Kumar, Advocate holding brief of Sri Rohit Yadav, learned counsel for the respondent no.3.
The petitioner has taken agricultural loan of Rs.96,000/- from respondent no. 3 for purchase of buffaloes for the business of dairy but due to some unavoidable circumstances, she could not deposit the installments on time and, therefore, the bank started recovery proceeding against her. In pursuance thereof, the respondent no. 3 has issued recovery proceedings against her on 16.05.2019.
Learned counsel for the petitioner submits that the petitioner is ready and willing to pay the amount but some time may be granted, to which learned counsel for the respondent no. 3 has no objection.
Accordingly, the writ petition is disposed off with liberty to the petitioner to deposit the entire amount due in four equal installments; the first installment shall be paid by 31st July, 2019, the second by 31st October, 2019, the third by 31st January, 2020 and the fourth by 30th April, 2020. While depositing the last installment, the petitioner shall also pay the interest due on the date of payment of last installment. The respondents are restrained to take any coercive action against the petitioner during the aforesaid period. In case of any default by the petitioner in payment of the installment, the protection granted herein above shall stand automatically vacated.
