1. This writ petition has been filed by the petitioner challenging the order dated 28.02.2018 passed by the Licensing Authority cancelling the fair price shop licence of the petitioner.
2. It has come out during the course of argument that the petitioner had already preferred an Appeal against the order of cancellation before the Appellate Authority along with a Stay Application and in the prayer clause due to inadvertence no prayer has been made for deciding the Stay Application preferred along with the Appeal.
3. Accordingly, this writ petition is disposed off with a direction to the Appellate Authority to consider and decide the Stay Application said to be pending before him since 21st of March, 2018 within a period of two weeks from the date a certified copy of this order is produced before him. The Appellate Authority shall thereafter make an effort to decide the Appeal itself on merits within a further period of eight weeks.
4. The writ petition is disposed off accordingly.
