Heard learned counsel for the petitioner and learned counsel representing respondent no. 3.
This writ petition has been filed seeking following relief:-
"issue an order or direction in the nature of mandamus directing the respondent no. 2 to decide the restoration application dated 19.10.200 in Case No. 37/17 of 1983 (Ramashrya Vs. Town Area) under Section 123(1) L.R. Act filed against Ex-party order dated 20.03.1985 pending in the court of Sub Divisional Magistrate, Gola, District Gorakhpur within stipulated period as fixed by this Hon'ble court."
It has been stated that a restoration application filed by the petitioner is pending consideration since the year 2002.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2 Sub Divisional Magistrate, Gorakhpur to decide the case as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before him.
