Heard Sri Lallan Chaubey, learned counsel for the petitioner, Sri Prabhash Pandey, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to discharge the petitioner from his duty of care taking of minor Km. Neha Pal in pursuance of application dated 8.6.2018 and 6.7.2018. A further prayer has also been made directing the respondent against unwarranted harassment of petitioner on false allegations.
It has been contended by learned counsel for the petitioner that the petitioner was given the custody of respondent no.5, Km. Neha Pal, a newly born baby, who was deserted by her parents at the instance of Village Pradhan as well as other villagers. He further submitted that the petitioner has also brought up the respondent no.4 and has done everything for her welfare, now she is aged about 16 years minor girl and she appears to have developed some relationship with respondent no.4 and eloped with him. He further submits that the petitioner has approached the S.S.P., Allahabad for registering the FIR against respondent no.4 but his FIR was not registered and and thereafter he has also moved to the District Magistrate to re- leave him for custody of respondent no.5 but no heed is being paid by the authority concerned.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the the District Magistrate, Allahabad to look in to the matter and do the needful at the earliest.
With the above directions this petition is finally disposed of.
