Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief:-
"(I) Issue a writ, order or direction in the nature of Mandamus direct the respondent no. 2 i.e. Sub Divisional Officer, Marhiyahoon, Jaunpur to decide the restoration application No. T201814360605507 filed on 23.02.2016 under order 9, Rule 9 C.P.C. in case no. 497 of 2003 (new No. 283 of 2016) computer No. T20131436062172, U/S 229B, U.P.Z.A. & L.R.
Act namely Ram Dular Vs. Gram Sabha and another, which is pending before him since 09.07.2003/04.07.2003, village Kumbh, pargana & Tehsil Marhiyahoon, Jaunpur, within stipulated period as fixed by this Hon'ble Court."
The petitioner is aggrieved as his application for setting-aside an order dismissing his declaratory suit under Section 229-B of the U.P.Z.A. & L.R. Act for default is pending since February, 2016.
Under the circumstances, this writ petition is disposed of with a direction to the respondent no. 2/Sub Divisional Officer, Marhiyahoon, Jaunpur to decide the restoration application as expeditiously as possible, preferably within a period of two months from the date a certified copy of this order is filed before him.
