Heard learned counsel for petitioner and learned standing counsel.
Present petition is filed by the petitioner for a mandamus claiming that private individual has occupied Gaon Sabha land. Instructions was sought from the learned standing counsel. Today, learned standing counsel on the basis of instructions states that unauthorized encroachment from the land of Gaon Sabha has been removed. The said aforesaid statement of the learned standing counsel is taken on record.
It is provided that in view the petitioner still finds that any unauthorized possession on Gaon Sabha land still exists, liberty is granted to him to file appropriate application before the Assistant Collector concerned within three weeks. In case such an application is filed, the Assistant Collector concerned after hearing all the parties concerned, shall pass order in accordance within law within three months.
With the aforesaid, the writ petition is disposed of.
