In view of the guidelines of this Court dated 7.4.2021, the bail applications have been directed to be heard through video conferencing.
Heard learned counsel for the applicant and learned A.G.A. for the State through video conferencing.
The instant anticipatory bail application has been filed with a prayer to grant an anticipatory bail to the applicant, Ram Dixit @ Ram Govind, in Case Crime No.469 of 2018, under Sections- 147, 354Kha, 354Ka, 294, 323, 501, 385, 504 I.P.C., 8 POCSO Act and 3(1)(x) S.C./S.T. Act, Police Station- Rasoolabad, District- Kanpur Dehat.
There is allegations of sexual harassment, extortion, threat, etc., against the applicant. The applicant has also been implicated for offence under Section 3(1)(x) S.C./S.T. Act. Charge-sheet has already been submitted against applicant on 20.5.2019. No material in support of charge-sheet has been brought on record. Nothing has been mentioned in the application as to what happened after filing of the charge-sheet. The copy of the order sheet of court below has also not been annexed with the application.
In view of paragraph-45 of the judgement of this Court dated 5.4.2021 passed in Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No.2110 of 2021 (Shivam Vs. State of U.P. and another), this anticipatory bail application is not maintainable.
It is accordingly rejected.
