The present writ petition has been filed against the order dated 15.2.2006 passed by the Settlement Officer of Consolidation dismissing the recall application filed by the petitioners as well as against the order dated 6.6.2019 passed by the Deputy Director of Consolidation affirming the order dated 15.2.2006 passed by the Settlement Officer of Consolidation.
The order dated 15.2.2006 has been passed by the Settlement Officer of Consolidation after recording a finding that the petitioners had been deliberately absenting themselves during the proceedings in the case even though admittedly they had notice of the appeal. The findings have been recorded by the Settlement Officer of Consolidation after considering the records of the case and the materials available before him. The petitioners have not been able to show any perversity in the findings recorded by the Settlement Officer of Consolidation in his order dated 15.2.2006 or that the findings recorded by the Settlement Officer of Consolidation are contrary to the records of the case. The order dated 15.2.2006 was rightly affirmed by the Deputy Director of Consolidation vide his order dated 6.6.2019.
The writ petition lacks merit and is, hereby, dismissed.
