Heard Ms. Savita Jain, learned counsel for the petitioner and Sri Rishabh Kapoor, learned counsel for the opposite parties.
Learned counsel for the petitioner has submitted that for getting the post retiral dues of her husband, the petitioner has preferred representation dated 7.1.2020 (Annexure No.6) to the competent authority but no order has yet been passed by the competent opposite party. Learned counsel for the petitioner has further submitted that the petitioner is willing to prefer a fresh representation taking all pleas and grounds, which are available to her and direction for disposal of such representation may be issued.
Considering the aforesaid request of learned counsel for the petitioner, I hereby dispose of this writ petition at the admission stage finally permitting the petitioner to prefer a fresh representation to opposite party no.3 i.e. Executive Engineer-II, Construction Division (E/M), U.P. Jal Nigam, Agra taking all pleas and grounds, which are available to her, within a period of fifteen days from today and if such representation is preferred within aforesaid stipulated time, opposite party no.3 is directed to consider and decide the said representation of the petitioner strictly in accordance with law, by speaking and reasoned order, with expedition, preferably within a period of two months from the date of receipt of copy of this order. Since grievance of the petitioner is relating to the payment of post retiral benefits of her husband, therefore, it is expected that if there is no legal impediment in making payment of aforesaid post retiral benefits, the competent authority shall pass appropriate orders regarding making payment of post retiral benefits.
