The petitioner who was granted a patta in the year 1976 continued to be in possession over the plot in question. Thereafter, when she was dispossessed from the land in question she moved an application before the Sub-Divisional Magistrate, Azamgarh. The grievance of the petitioner is that the Sub-Divisional Magistrate, Azamgarh was not taking any action on the petitioner's application.
Learned counsel for the petitioner submits that under Section 129 of the U.P. Revenue Code, 2006, if a Bhumidhar is not getting possession despite the fact that he has a patta then he can be put back into possession by the authorities.
However, without commenting anything on merits of the case, the Sub-Divisional Magistrate, Azamgarh is directed to decide the application of the petitioner dated 03.08.2018 within a period of one month from the date of presentation of a certified copy of this order.
The writ petition is disposed of.
