Heard learned counsel for the parties.
The grievance of the petitioner is with respect to the allotment of the fair price shop situated at Gram Panchayat Rammapurwa, Simariya, District Kannauj, which fell vacant due to death of husband of the petitioner on compassionate ground as there is no any source of income to the petitioner and her family.
On the matter being taken up today, learned Standing Counsel has apprised to the Court that in compliance of the order passed by this Court in Sumpurnanand vs. State of UP and 2 others (Writ C No. 16948 of 2018 decided on 26.10.2018) reported in 2018 (11) ADJ 550, the State Government has taken a policy decision on 15.2.2019 regarding the allotment of fair price shop dealer for rural area as well as urban area under dying-in- harness quota.
In the facts and circumstances of the case, once the State Government has already taken a policy decision on 15.2.2019 regarding the settlement of the fair price shop on compassionate ground, then the authority concerned would proceed in the matter and accord an opportunity to the petitioner within ten days from the receipt of certified copy of this order for taking necessary steps in compliance of the Government order dated 15.2.2019. In case in response of the aforesaid Government order dated 15.2.2019 any such application alongwith the requisite fee and other relevant papers are being placed before the authority, then the authority concerned would take a final call in the matter expeditiously.
With these observations, the writ petition is disposed of.
