Supplementary affidavit filed today is taken on record.
It is not disputed by the learned counsel for the applicant that alleging disobedience of an order of injunction, an application under Order XXXIX Rule 2A CPC has been moved.
The grievance however is that the concerned Civil Judge has not taken up the said application for disposal till date.
The Court must note that an application under Order XXXIX Rule 2A must by its very nature and character be taken up for disposal on priority as the allegation of contempt must be attended to and further action as warranted taken without any delay.
In view thereof, this petition shall stand disposed of with a direction to the concerned Civil Judge before whom the said application is pending to take up the same and ensure its disposal forthwith.
