Ram Dev Dwivedi & Another vs Dios

High Court Of Judicature at Allahabad|06 January, 2010

JUDGMENT / ORDER

Heard Sri Rahul Jain, learned counsel for the petitioners.
This writ petition has been filed for quashing the order dated 27.12.1991, Annexure-6 to the writ petition by which the appointment of the petitioners on adhoc basis has been cancelled. This Court entertained the writ petition and by order dated 18.5.1992 passed an interim order to this effect that the petitioner will be permitted to continue and will be paid salary. The petitioner submits that in pursuance of the interim order passed by this Court, the petitioners are still working and are entitled for regularization in view of Section 33 (C) of the U.P. Secondary Education Service Selection Board Act 1982. It has also been informed that the papers relating to regularization of the petitioners have already been forwarded by the Committee of Management to the concerned District Inspector of Schools. Now the question for consideration is regarding regularization by the competent authority.
In view of the aforesaid fact, this writ petition is disposed of finally directing the District Inspector of Schools to forward the relevant papers to the Regional Level Committee for consideration of the claim of the petitioners for regularization according to law and the papers will be sent within one month from the receipt of certified copy of this order and the Regional Level Committee will pass appropriate orders after affording opportunity to the petitioners within three moths thereafter.
The writ petition is disposed of accordingly.
No order is passed as to costs.
