Heard learned counsel for the petitioners and learned State Counsel.
This petition challenges an order dated 25.06.2019, passed by the Tehsildar (Judicial), Gonda, whereby some restoration application moved by the petitioners has been rejected.
Admittedly, the said order dated 25.06.2019 is revisable/appellable under the relevant provisions of U.P. Revenue Code, 2006. Further, the writ petition under Article 226 of the Constitution of India against the order passed in mutation proceedings would normally not lie.
For the aforesaid reason, without interfering in the order impugned herein, this writ petition is finally disposed of with the liberty to the petitioner to file appeal/revision against the impugned order before the appropriate court/forum under U.P. Revenue Code, 2006. If any appeal/revision is preferred by the petitioners, the appellate court/authority shall expedite the proceedings thereof.
