Heard learned counsel for the petitioner and learned Standing Counsel and perused the record.
Present writ petition has been filed by the petitioner with the following prayer :-
"To issue a writ, order or direction in the nature of mandamus directing the respondent to decide Case No.41 of 2020 (Sriram Vs. State) which is pending in the Court of respondent within stipulated period".
It is averred in the writ petition that petitioner has moved an application dated 10.07.2020 Under Rule 109 of U.P.C.H. Rules (Annexure No.2) for implementation of order dated 22.02.2021 passed by Consolidation Officer. The aforesaid application is pending since the date of filling. i.e. 10.07.2020 in the Court of Consolidation Officer-II Bahatpar Rani, Camp Deoria, District-Deoria.
Learned Standing Counsel has fairly contended that he has no objection if this Court issues a direction for early disposal of the application dated 10.07.2020, which is pending disposal.
Be that as it may, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Consolidation Officer- II Bahatpar Rani, Camp Deoria, District-Deoria, before whom the Application dated 10.07.2020 (Annexure-2) is pending disposal, to decide the same expeditiously, preferably, within the period of three months from the date in receipt of copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file a computer generated copy of this order downloaded from the official website of High Court, Allahabad, supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observations, present writ petition is disposed of.
