1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioner has sought following reliefs:
“a) to issue a writ, order or direction in the nature of certiorari for quashing the impugned advertisement No. 1 of 2002 published on 11.9.2002 in daily newspaper 'Dainik Jagran' issued by the U.P. Education Service Selection Board, Allahabad (filed as Annexure No. 7 to this writ petition) so far as the same for pertaining to Shri Kalika Uchchatar Madhyamik Vidyalaya, Mohanganj, District Pratapgarh.
b) to issue a writ, order or direction of a suitable nature commanding the respondents not to interfere in working of the petitioner as Assistant Teacher in L.T. Grade in Sri Kalika Uchchatar Madhyamik Vidyalaya, Mohanganj district Pratapgarh and to pay the petitioner regular salary on the said post.
c) issue a writ, order or direction in the nature of mandamus commanding respondents to declare the provisions of Rule 12 of the U.P. Secondary Education Service Selection Board Rule, 1998 as null and void and unconstitutional and in operative.
d) issue a writ, order or direction in the nature of mandamus directing the respondents to regularise the service of the petitioners as Assistant Teacher in LT grade in the institution in question and to pay his all benefits as such.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
