1. Heard Sri Ajit Kumar Srivastava holding brief of Mr. Sanjay Kumar Srivastava, learned counsel for petitioners and learned Standing Counsel for State.
2. Petitioners have filed this writ petition for mandamus commanding respondent no. 2, District Magistrate, Kanpur Nagar and respondent no. 3, District Programme Officer, Kanpur Nagar to pass and appropriate order for allotment of house under Pradhan Mantri Gramin Awas Yojna.
3. In our view, as the matter requires investigation into facts and entitlement of petitioners before passing an order of allotment in their favour, it would be appropriate that grievance of petitioners should be examined and decided by respondents-Competent Authority at the first instance.
4. Considering the facts and circumstances of case as noted above but without expressing any opinion on merits, we dispose of this writ petition permitting petitioners to make an application ventilating their grievance before respondent no.2-District Magistrate, Kanpur Nagar alongwith certified copy of this order within ten days from today. On receiving such an application, authority concerned shall examine the matter and pass an appropriate order expeditiously in accordance with law and in any case, within one month from the date of production of a certified copy of this order before him.
