Heard learned counsel for the petitioner and Shri Manoj Kumar Yadav for the Gaon Sabha, respondent no. 5.
Challenge in the writ petition is to an order passed by the Sub Divisional Magistrate in a suit under Section 229B of the U.P. Zamindari Abolition and Land Reforms Act as also the order passed in the consequential appeal by the Commissioner.
Against the orders impugned, the petitioner has a statutory alternative remedy of a second appeal before the Board of Revenue as provided under Section 331(4) of the U.P. Zamindari Abolition and Land Reforms Act, which statutory alternative remedy has not been availed.
Under the circumstances, this writ petition is dismissed on the ground of availability of a statutory alternative remedy.
