This petition is directed against an order passed by Executive Officer, Nagar Panchayat Babrala, District Sambhal dated 9th March, 2019, whereby clerical work has been directed to be performed by respondent no.6. Petitioner, who is a Class-IV employee, states that he was continuing for the last 09 years on this post.
Petition is opposed by Sri A.K. Singh Baghel, learned Additional Chief Standing Counsel. It is stated that petitioner has no right to perform work of a Class-III employee.
From a perusal of the materials brought on record, it appears that respondent no.6 has been appointed on a Class-III post and is working in the Nagar Panchayat concerned. In case clerical work is directed to be performed by her, no exception can be taken to it. Petitioner is substantively appointed as a Class-IV employee. No right is acquired by the petitioner to work on a Class-III post merely because he has worked for few years in the past. Order impugned dated 9.3.2019, therefore, does not suffer from any infirmity which may require any interference.
Writ petition, accordingly, is dismissed.
