Petitioners claim to have been engaged by Zila Panchayat from 1990-1991 but the records relating to their engagement are available only from 1996-1997. It is submitted that they are continuously working and their services are liable to be regularized in accordance with the Government Order dated 24.2.2016. Submission is that though petitioners fulfill requisite eligibility in terms of the Government Order as also the Uttar Pradesh Regularization of Persons Working On Daily Wages or On Work Charge or On Contract In Government Departments On Group "C" And Group "D" Posts (Outside The Purview Of The Uttar Pradesh Public Service Commission) Rules, 2016, but their claim has not been considered, so far.
Sri Anil Kumar Singh Baghel, who has accepted notice on behalf of Zila Panchayat, points out that petitioners' claim for regularization has already been recommended to the concern Principal Secretary of the State Government but since no approval has been obtained, as such the matter has been kept pending.
In the facts and circumstances, as have been noticed above, it would be appropriate to dispose of this writ petition with the observation that petitioners shall approach the third respondent, alongwith certified copy of this order, within two weeks from today. The Chairman concerned shall examine petitioners' claim and if it is found to be covered by the Rules of 2016, necessary recommendation would be made to the State, within a further period of four weeks. The first respondent shall issue necessary directions, within a further period of two months, thereafter. Consequential orders would be passed by the Zila Panchayat, within a further period of two weeks from the date such clarification/approval is received from the State.
Writ petition, accordingly, stands disposed of.
