Learned counsel appearing for the applicant contends that the applicant was taken in police custody on the night of 5/6.11.2011 at about 12.30 a.m. Communication was given to various senior officers in regard to the same. F.I.R. in regard to the alleged incident was lodged on 11.11.2011 and, therefore, possibly the applicant cannot have any connection with the incident. It is only because the applicant had made a complaint against the police officials, he has been implicated in the case through the statement of the prosecutrix recorded under Section 164 Cr.P.C. on 21.11.2011, that is after five days of her recovery on 16.11.2011.
Let a specific counter affidavit be filed specifically admitting or denying the documents placed on record by the applicant including the medical health of the applicant after verifying the same from the concerned doctors of the Hospital.
