The sole prayer made in the instant petition is for issuing direction to the Executing Court to decide Execution Case No. 11 of 2017 within a specified time frame.
The execution proceedings in question are pending on the basis of application filed by the petitioner-decree holder. According to the petitioner, Original Suit No.245 of 1998 was decided in appeal in terms of a compromises before Lok Adalat. The said decree is under execution.
Having regard to the entire facts, the instant petition is disposed of with direction to the Executing Court to ensure that the execution proceedings are brought to their logical end expeditiously by fixing short dates and without granting unnecessary adjournments.
