JUDGMENT / ORDER

The petitioner's Writ Petition No.5904 (SS) of 2002 was finally allowed by the Writ Court vide judgement and order dated 19.12.2018 with direction to provide all consequential benefits while quashing the order dated 20/21.09.2002, whereby the petitioner was compulsorily retired. It was also directed to pay the petitioner back wages @ 50%.
In pursuance to the notice issued in this contempt petition, a compliance affidavit of Mr. Anuj Kumar Jha, District Magistrate, Faizabad (Now Ayodhya) has been filed. Paragraphs 4, 5 and 6 of the aforesaid affidavit read as under :-
"4. That the deponent most humbly and respectfully submits that in compliance of the order dated 19.12.2018 passed by this Hopn'ble Court in Writ Petition No.5904 (SS) of 2004 ( Ram Charitra Yadav Versus The State of U.P. Thru Secretary, revenue, Lucknow and 3 others )the deponent vide order dated 19.7.2019 has allowed the payment of service benefits i.e. Pension, Gratuity, GPF and GIS from the date of retirement i.e. 31.05.2007. Further the Deponent allowed 50% back wages of arrears of salary on total Emoluments from 20.09.2002 to 31.05.2007 of the petitioner. The true copy of order dated 19.07.2019 is marked as Annexure No.A-1 to this Affidavit.
5. That it necessary to mention here that in lieu of order dated 19.07.2019 the Additional Director, Treasury and Pension, Faizabad Mandal, Faizabad vide payment order dated 14.08.2019 has paid the pension to the petitioner and further Group Insurance Claim of Rs.32,648/- was paid by Treasury Officer, Ayodhya. The true copies of order dated 14.08.2019 and Group Insurance Claim is marked as Annexure No.A-2 & A-3 to this Affidavit.

That further 50% of back wages of arrears of salary on total Emoluments i.e. Rs.3,45,367/- and Leave encashment amount of Rs.1,83,060/- has been deposited in the bank account no.00690100012526 of the petitioner. The true copies of receipts of e-payment are marked as Annexure No.A-4 & A-5 to this Affidavit."
With respect to the payment of Provident Fund of the petitioner, details of Provident Fund Account No.RUV26680 of the petitioner has been sent to the Accountant General, Accounts and Entitlement-!, Fund-16, Uttar Pradesh, Allahabad on 14.8.2019 for verification and it has been said that same shall be paid after verification report of the Accountant General.
In view of the aforesaid, nothing survives in the present contempt petition, which is hereby dismissed as having become infructuous.
However, respondents are directed that once the verification in respect of the Provident Fund of the petitioner is received from the office of the Accountant General, the same shall be paid within a period of one month from the date of the report of the verification.
Contempt notice stands discharged.
