Heard Sri Amit Kumar Srivastava, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to decide the Special Trial No. 35 of 1994, State Vs. Ram Charan Mishra arising out of Case Crime No. 1428 of 1993 under Section 7/13 (1)(d) read with Section 13 (2) of Prevention of Corruption Act, 1988 P.S. Cantt, District Gorakhpur expeditiously within a stipulated period.
Learned counsel for the petitioner contends that applicant is the accused in this case. Trial in this case is pending since 2015. Till now, no witness has been recorded by the trial court, hence direction is sought to be issued for expeditious disposal.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months from today, if there is no legal hurdle, without permitting undue adjournments to either sides.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
