The petitioners have preferred this writ petition for issuance of a direction upon the Consolidation Commissioner, U.P., Lucknow that notice under Section 4 of the U.P. Consolidation of Holdings Act, 1953 be cancelled, amongst other on the ground that most of the villagers do not want consolidation proceedings.
It is contended that to ventilate their grievance the villagers have made a representation to the Consolidation Commissioner, which is on the record as annexure-4 to the writ petition.
I have heard learned counsel for the petitioners and the learned Standing Counsel.
Having due regard to the facts of the case, in my view, the ends of justice would be subserved by issuing a direction upon the Consolidation Commissioner-respondent no. 2 to consider the grievance of the petitioners and pass appropriate order after inviting comments from the concerned authorities, expeditiously, preferably within four months from the date of communication of this order.
It is made clear that this Court has not expressed its opinion on the merits of the case. The respondent no. 2 shall pass the order independently and in accordance with law.
The writ petition is, accordingly, disposed of. No order as to costs.
