Heard learned counsel for the petitioner and learned Standing Counsel for State authorities.
By means of this writ petition, the petitioner has come to this Court alleging that some private persons have taken forcible possession over the property of the petitioner. Those persons have not been made party. By means of this writ petition petitioner has prayed that the District Magistrate be directed to evict the unauthorized persons from the land in question and petitioner's possession be restored.
The petitioner claims right and title over the property through a sale deed. In case, the petitioner has any right over the land in question, he may get the same declared by approaching proper Court having jurisdiction, and, if somebody is causing hindrance in enjoyment of his property, he may get him injuncted by filing suit for injunction. By deciding a representation, the District Magistrate has no authority to determine title of parties.
The writ petition is misconceived. Dismissed.
