JUDGMENT / ORDER

Hon'ble Rajeev Singh,J.
Heard Shri Lalji Yadav, learned counsel for the petitioner and Shri S.P. Singh, learned AGA for the State-respondents.
This writ petition has been filed by the petitioner to issue a writ, order or direction in the nature of mandamus directing the opposite party not to arrest the petitioner and with further prayer for quashing the impugned FIR dated 05.08.2020 registered as case crime no.512 of 2020, under Sections 147, 148, 149, 452, 354-B, 323, 504, 506, 307, 308, 286, 188, 269, 270, 376-D IPC and Section 51 of Disaster Management Act, 2005 and Section 7 of Criminal Law Amendment Act, 1932, Police Station Lalganj, District Pratapgarh.
Learned counsel for the petitioner, after arguing at some length, prays that this writ petition be dismissed as not pressed with liberty to avail appropriate remedy as available to him under law.
Learned AGA has drawn attention of this Court towards a writ petition earlier filed by him in Misc. Bench no.16482 of 2020 in which he challenged the impugned FIR and the same was dismissed as withdrawn with liberty to the petitioner to approach the Court concerned under Section 438 Cr.P.C.
The present writ petition had been filed for the same cause of action for which learned counsel for the petitioner states that during the course of investigation offence under section 376 IPC has been added.
In view of the above this writ petition is dismissed as withdrawn without any further liberty.
