Heard learned counsel for the petitioners and learned Additional Government Advocate.
By means of this Writ Petition, the petitioners have approached this Court with the prayer for quashing of NCR No. 93 of 2010 under sections 323, 504 & 506 IPC which was later on converted to Case Crime No. 174 of 2010 under Sections 323, 504, 506 & 326 IPC of Police Station Kotwali Patti, District Pratapgarh.
We have gone through the contents of the First Information Report and other documents annexed along with the writ petition.
Since the contents of the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
However, seeing the manner in which the non-cognizable report has been converted into crime number thereby adding Section 326 IPC., we direct that the petitioner shall not be arrested in the above mentioned case crime number till cogent and reliable evidence comes against him subject to his cooperation in the investigation, which shall go on.
With the observations/directions, the writ petition is finally disposed of.
