Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
Present petition has been with the following prayer:-
"(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 7.10.2006 passed by Circle Officer, Afzalgarh, District- Bijnor by order dated 12.3.2008 passed by Inspector General of Police, Moradabad Region Moradabad.
(ii) Issue a writ, order or direction in the nature of mandamus directing to authority concerned to provide promotional pay scale as well as over service benefit."
Learned Standing has raised objection and submitted that present petition has been filed with inordinate delay of 13 years without any proper explanation, therefore, petition is liable to be dismissed on the ground of laches.
On being confronted by the Court, learned counsel for the petitioner could not demonstrate any reason for explaining the inordinate delay of 13 years in the affidavit, therefore, objection of learned standing counsel is sustainable and liable to be accepted.
Accordingly, the writ petition is dismissed on the ground of laches.
