Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the record.
The petitioner moved an application on 27th October, 2009 seeking information from the competent authority under the RTI Act. The application was disallowed by the order dated 11th December, 2009 with the averments information sought by the petitioner is advisory. Petitioner preferred a Statutory Appeal against the order dated 11th December, 2009 on 20th April, 2010 against the order passed by the competent authority which was decided vide order dated 18th May, 2010 relegating the matter, it has been referred on 05.05.2010 to Secretary, Legislature State of U.P. to provide required information. A copy of the same has been filed as Annexure No. 1 to the writ petition.
From perusal of the impugned order, it appears that competent authority/appellate has not decided the representation /appeal within the statutory period. Matter is pending for more than bundles. Now it is within the boundary of Secretary, Legislature /State of U.P.
It has been stated by the petitioner's counsel that Secretary, Legislature has not communicated the decision till date.
From the facts and circumstances of the case, material on record, it appears that no decision has been taken within a period provided under the RTI Act and the matter is pending for about one year. Keeping in view the material on record instead of relegating the matter to the competent authority we direct the Secretary, Legislature, State of U.P. Lucknow to take a decision in the reference made on 05.05.2010 expeditiously say within a period of one month from the date certified copy of this order is served and the decision be communicated to the petitioner.
Subject to above, this writ petition is finally disposed of.
