The writ petition is being filed seeking following relief:
"issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 Deputy Collector Rudrapur, District Deoria to decide Case No. 90 of 2009-10 Ram Briksh Versus Sharda Singh & others under Section 176 of U.P. Z.A. & L.R. Act, 1950 expeditiously, perferably within the period specified by this Hon'ble Court"
The counsel for the petitioner is not is a position to state as to whether issue have been framed in the suit for partition and as to whether the parties have led their evidence.
Under the circumstances the writ petition is disposes of with the observation that the trial court may endeavour to decide the suit as expeditiously as possible preferably within a period of 18 months from the date certified copy of this order is filed before it.
