Heard learned counsel for the parties and perused the record.
The writ petition has been filed for the following reliefs :-
"(i) issue a writ, order or direction in the nature of mandamus commanding the respondents to decide the representation of petitioners which has been pending till today.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 to withdrawal of four F.D. (1 A/C- 1183 Receipt no.023290 with rupees 99319/- with interest. 2. A/C- 1184 Receipt no.023291 with rupees 89385/- with interest. 3. A/C0-1628 Receipt no.023288 with rupees 80284/- with interest. 4. A/C- 1629 Receipt no.023289 with rupees 80284/- with interest.) which have already been matured on 21.6.2018 and also directed to the respondent no.3 to withdrawal of R.D. Account No.-669 with the amount 35000/- with interest."
In pursuance of the Court's order dated 7.8.2019, Mr. Ayodhya Prasad, Branch Manager, Branch Chauri Chaura, District Cooperative Bank Ltd., Gorakhpur, is present in person today before this Court.
Learned counsel for the petitioner has submitted that he has received Rs.4,29,000/- against the F.D.R. It is further submitted that still he is entitled to receive Rs.15,000/- more from the Bank.
Learned counsel for the Bank submitted that the entire amount has been paid to the petitioner along with interest.
According to the respondent, interest @ 7% has been paid for period before expiry of F.D.R., and thereafter, interest was paid @ 3.5% to the petitioner.
Considering the facts and circumstances of the case, we are of the view that the petitioner has already received the amount of F.D.R. from the Bank along with the interest. No cause survives in the matter.
With the aforesaid observations, the petition stands disposed of.
