Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
The petitioner is before this Court for a direction to the Civil Judge (Junior Division), Court No. 10, Deoria to decide the Original Suit No. 239 of 1994 (Ram Bilash vs. Sunaina), within stipulated period.
It is unfortunate that inspite of the fact that more than 27 years has already been lapsed, till date no decision has been taken on the same.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division), Court No. 10, Deoria to consider and decide the aforesaid suit in accordance with law positively within a period of one year from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
