The petitioner has approached this Court for a direction upon the Central Administrative Tribunal, Allahabad to decide Original Application Nos.1079 of 2017 and 606 of 2018 (Ram Bharoshey Ram verus Union of India and others), expeditiously within the stipulated time that may be fixed by the Court.
In the facts and circumstances of the case, we do not consider it appropriate to issue any time bound direction to the Tribunal for deciding the above original applications, in view of the decision of this Court in Km. Shobha Bose versus Judge Small Causes Court 2010 (1) ADJ 531 (DB).
The Court is not aware if the roaster and the pendency of the other old cases before the Tribunal and it would be inappropriate to direct for the decision of the above applications within a time bound period on priority leaving the other old cases that may be pending before the Tribunal.
However, petitioner is given liberty to approach the Tribunal with an application for early disposal of the above applications and it is expected that, in case, any such application is moved, the tribunal will consider it depending upon its roaster and the urgency in the matter in question.
The petition is disposed of accordingly.
