The contention of the petitioner is that as per the Government Order dated 29.7.2004 (Clause 2(I)), the satisfaction of the Authority ought to have been there in the order stating that the enquiry which was initiated as per the Order of suspension would result in the termination of the licence. Learned counsel for the petitioner submits that the order also ought to have indicated the punishment which was proposed.
Learned counsel for the petitioner relies upon a decision of this Court dated 24.7.2019 passed in Writ C No. 22715 of 2019 ( Smt. Sunita vs. State Of U.P. And 2 Others).
Learned Standing Counsel, however, prays for and is granted three weeks' time for filing a counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks, thereafter.
List thereafter.
However, since a perusal of the order shows that it does not disclose any satisfaction, the effect and operation of the impugned order dated 31.7.2019 shall remain stayed.
However, the enquiry as per the show cause notice may continue and be concluded within a period of one month.
