Heard learned counsel for the petitioner and Shri B.B. Pandey, learned Addl. Chief Standing Counsel.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner, who is complainant, is before this Court for a direction to third respondent to expedite the proceeding under Section 122-B of UPZA & LR Act/ Section 67 of U.P. Revenue Code, wherein allegations have been levelled against the private respondents that they have encroached upon the public utility land. It is contended that cognizance has already been taken on 11.10.2017 but the proceeding has not been finalised as yet.
On the other hand, learned Addl. Chief Standing Counsel raised an objection that once cognizance has been taken on the complaint made by the petitioner in the aforesaid proceeding, then there is no inordinate delay in deciding the same and no interference is required in the matter.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the writ petition stands disposed of asking the third respondent to decide the aforesaid proceeding in accordance with law expeditiously but certainly after giving opportunity to the parties concerned.
