Ram Bhajan Kushwaha vs State Of U.P. Thru' Principal ...

High Court Of Judicature at Allahabad|25 November, 2010

JUDGMENT / ORDER

None appears on behalf of the petitioner to press the writ petition despite having been called in revised list. However, I have perused the record.
It is not the case of the petitioner that the impugned order of transfer is against statutory rules or has been passed by an authority not competent to do so or is vitiated on account of mala fide. The service of the petitioner are transferable. The transfer being exigency of service, an employee is liable to be transferred from one place to another and normally no case for interference in Court of law is called for unless the case is within categories, as mentioned above.
In my view no interference is called for.
Even otherwise four years have passed since the above writ petition was filed and one cannot claim to remain at one place for all times to come.
In view of above discussion and in the facts and circumstances of the case, I find no merit in the petition. The writ petition is accordingly dismissed. The interim order, if any, stand vacated. No order as to costs.
