Heard Sri Gokaran Singh, learned counsel for the petitioner, Sri Ramesh Chandra Upadhyay, learned counsel for the respondent no. 4 and learned standing counsel for the respondent nos. 1 to 3.
This writ petition in the nature of PIL has been filed by the petitioner seeking a direction to the respondents to remove the illegal encroachment of private respondent nos. 5 to 8 from Araji No. 1076, area 0.0400 hectare, which according to the petitioner is recorded as Navin Parti and Araji No. 1077, area 0.0100 hectares, which is recorded as chak marg in the revenue record.Extract of revenue record has been annexed as Annexure-1 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the Respondent No. 3, Assistant Collector, Ghosi, Mau, District Mau to enquire into the matter and take appropriate action in accordance with law within a period of two months from the date of receipt of a certified copy of this order.
It is made clear that this Court has not adjudicated the claim of the petitioner on the merits of the case.
