Heard Sri Kailash Chandra learned counsel for the petitioners and Sri Alok Kumar Srivastava learned Standing Counsel for the State-respondents on the delay condonation application as well as substitution application.
Cause shown in the affidavit filed in support of delay condonation application is sufficient.
The delay in filing the substitution application is condoned.
Accordingly, the delay condonation application no.96705 is allowed.
Learned counsel for the petitioners has submitted that the petitioner no.1 namely, Ram Bahor Mishra died on 23.02.2019 leaving his behind Shitla Prasad Mishra and Triveni Shanker Mishra, who is already arrayed as petitioner no.2 in the array of parties, as his legal heirs and representatives. It is thus prayed that he may be permitted to struck off the name of the petitioner no.1 and in his place Sri Shitla Prasad Mishra may be permitted to be substituted.
On due consideration, so also the fact that one of the legal heir of petitioner no.1 namely, Triveni Shanker Mishra is already on record, we therefore, allow the substitution application no.96706 of 2019.
Necessary substitution be carried out within a week from today.
