1. Supplementary affidavit filed today is taken on record.
2. Heard learned counsel for the applicant and Sri Ashwani Prakash Tripathi learned A.G.A. for the State.
3. This anticipatory bail application has been filed on behalf of the applicant - Ram Bahadur, seeking anticipatory bail in Case Crime No. 225 of 2021, under Sections - 323, 307, 504, 506 I.P.C., Police Station - Dannahar, District - Mainpuri.
4. At the outset parity has been claimed with Beche Lal who has been granted anticipatory bail by the learned Court below.
5. On the other hand, learned A.G.A. has referred to criminal history of seven cases of the applicant including offence under Sction 302 IPC as also the fact that the co-accused Beche Lal was 77 years of age on the date of anticipatory bail being granted.
6. Having heard learned counsel for parties and having perused the record, keeping in mind the nature of the allegations made and the criminal history of the applicant, the indulgence as prayed is declined.
7. Accordingly the present application is rejected with liberty to the applicant to apply for regular bail, which application when filed may be considered on its own merits and without being prejudiced by the observations made in this order.
