Heard Mr. R.N. Dwivedi, learned Advocate, holding for Mr. Harendra Yadav, learned counsel for the petitioner.
The grievance of the petitioner is that private respondents have encroached upon the “Nahar” Devkali Pump Canal IInd, which passes through Plot Nos. 59, 63, 66, 250, 487, 514, 526Kha, 928, 953Gha, 1075Ka, 1536Ka, 1544Ka, 1649, 1650, 1691 situated at Village Durkhushi, Pargana- Pachotar, Tehsil-Kasimabad, District Ghazipur, as a result of which a nuisance is being cause.
Having regard to this grievance, it is open to the petitioner to invoke the provisions of Section 133 of the Code of Criminal Procedure, 1973. We, accordingly, leave it open to the petitioner to move an appropriate application before the competent authority for an expeditious decision thereon.
The petition is, accordingly, disposed of. There shall be no order as to costs.
