In response to the order dated 22.8.2019, Sri R.K.Yadav, learned counsel for the opposite party has placed the instruction dated 26.09.2019 indicating therein that the gratuity amount of Rs. 5,49,675/- has been released in favour of the applicant by Cheque No. 914150 dated 26.09.2019.
Learned counsel for the applicant submits that till date the entire payment qua to the retiral benefits has not been extended to the applicant in compliance of the Writ Court's order and, thus, the opposite party has committed civil contempt liable for punishment under Section 12 of the Contempt of Courts Act, 1971.
Prima facie a case of contempt has been made out. However, considering the facts and circumstances of the case, one more opportunity is afforded to the opposite party to comply with the order of Writ Court and to ensure the entire payment towards retiral benefits to the applicant within two months from the date of production of a certified copy of this order, failing which, the applicant would be at liberty to move a fresh application, if the order is not complied with by the opposite party within the stipulated time as aforementioned.
With the aforesaid observations, this application is disposed of at this stage.
