None has appeared on behalf of the appellant to address the Court, even in the revised call. However, learned AGA is present.
The report of the Station House Officer, Police Station Mutthiganj dated 13.4.2018 addressed to the Chief Judicial Magistrate, Allahabad indicates that the sole appellant had expired on 28.12.1987. In this regard, death certificate was obtained from the Allahabad Municipal Corporation, which is annexed with the report of the SHO, Police Station Mutthiganj.
In view of death of sole appellant Ram Babu, the appeal has lost its efficacy. Accordingly appeal stands abated.
Let the order be transmitted to the Chief Judicial Magistrate, Allahabad for necessary compliance.
Appeal be consigned to the record.
