JUDGMENT / ORDER

Hon'ble Prakash Krishna,J.
This writ petition has been filed against the order dated 15.2.2012 passed by Judge Small Cause Court, Bareilly in Tax Appeal No. 19 of 2009.
Learned counsel for the parties agreed that against the order impugned, there is a statutory remedy by way of an appeal.
We cannot interfere in the writ petition under Article 226 of the Constitution of India. The petitioner may avail statutory remedy available to him by filing of an appeal.
Certified copy of the judgment dated 15.2.2012 be returned to the counsel for the petitioner.
The writ petition is dismissed on the ground of availability of alternative remedy.
