Heard learned counsel for the petitioner and Sri Kshitij Shailendra, learned counsel for the respondents.
The petitioner, by means of the present writ petition, has sought a writ of mandamus commanding the respondent no.2 to revise the salary of the petitioner in compliance of the order dated 25.10.2019, passed by the Registrar of the University (Annexure-1 to the writ petition) and accordingly revise the pension of the petitioner.
The grievance of the petitioner is that the petitioner has retired on 30.11.2016 from the post of Senior Technical Assistant and revision of pay has been sanctioned with the approval of Vice Chancellor vide order dated 25.10.201. Despite there being an order dated 25.10.2019 in favour of the petitioner, the salary as well as pension of the petitioner has not been revised.The petitioner in this respect has submitted several representations to the respondent no.2 but but no heed was paid on the same and the petitioner is running from pillar to post.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondents no.2-University of Allahabad through its Registrar, along with a copy of this order downloaded from the official website of High Court, Allahabad, raising all his grievances within a period of two weeks from today. In case, any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same strictly in accordance with law, by a reasoned and speaking order, preferably within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
