The matter has been called out in the revised list. Sri S. P. Shukla, learned counsel, has put in appearance on behalf of petitioner and Sri Ashok Kumar Yadav, learned counsel has put in appearance on behalf of respondent no.6.
The relief claimed in the writ petition was to quash the candidature of the candidate who was purportedly selected by the respondent no.6, U.P. Secondary Education Service Selection Board, Allahabad, in the year 1975. An interim order was granted on 12.10.2006, on the strength of which the petitioner continued on the post of Lecturer in Economics in the institution. The petitioner superannuated from service in the year 2007 hence no cause of action survives. The writ petition has become infructuous.
Since the petitioner has functioned on the foot of interim order no recovery shall be made for the aforesaid period of the service.
The writ petition is dismissed. Interim order stands discharged.
