Learned counsel for the applicant is permitted to correct the district from Azamgarh to Gorakhpur as the matter relates to the Labour Court, Gorakhpur during the course of the day.
By means of this contempt application, the applicant has alleged that inspite of direction of this Curt dated 31st May, 2017 passed in Writ C No. 24412 of 2017 filed at the instance of the Pradhan Prabandhak isan Sahkari Chini Mills Ltd., no final orders have been passed in the restoration application and restoration application has not yet been disposed of and there is stay operating over execution of the award passed in favour of the applicant.
It is stated that there was no Presiding Officer in the Labour Court till April, 2018. Now since May, 2018 the Labour Court Gorakhpur is properly functioning with Presiding Officer. Since, merely three months have passed when the Labour Court has started functioning in District Gorakhpur, after it remained a vacant for a long time, it is appropriate that instead of issuing notice in this contempt application, further direction is issued to the opposite party to pass final order on restoration application filed by the Pradhan Prabandha kisan Sahkari Chini Mills Ltd positively within period of one month from the date of production of certified copy of this order.
This application is accordingly disposed of with the aforesaid direction with liberty to the applicant to approach this Court again in case order passed today is not complied with by the concerned officer.
